La trajectoire singulière empruntée par mes travaux de recherche, ainsi que le constat d’une tendance toute naturelle des comparatistes à focaliser leur attention sur la réalisation de la comparaison proprement dite, au détriment de l’étape préalable du choix de la comparaison m’ont engagée à consacrer une réflexion d’ordre méthodologique à cette dernière. À partir de l’expérience vécue de la recherche doctorale, il s’agira de faire émerger deux séries de réflexions sur le cheminement emprunté par les juristes qui, dans une démarche sérieuse, font le choix de la comparaison. La première, qui correspond sans doute à l’« angle mort » de la réflexion méthodologique sur le choix de la comparaison, a trait à la constitution d’un « réflexe comparatif » chez le chercheur. La seconde, plus classique mais néanmoins incontournable, concerne la définition de l’objectif assigné à la recherche.

The unique path taken by my research, as well as the observation of a natural tendency of comparatists to focus their attention on the realization of the comparison itself, to the detriment of the preliminary stage of the choice of the comparison, have led me to engage in a methodological reflection of the latter. Drawing on the experience of my doctoral research, I will develop two series of reflections on the pathway chosen by jurists who, in a rigorous approach, have chosen comparison. The first, which undoubtedly corresponds to the “blind spot” of the methodological reflection on the choice of comparison, relates to the development of a “comparative reflex” in the researcher. The second, more traditional but nevertheless unavoidable, concerns the definition of the objective assigned to the research.
