In France, disabled persons who need personal assistance for essential life tasks and for care that go beyond basic body hygiene are faced with a double burden. Their needs and the dependency their disability creates are cumulative: the legal framework and professional culture sometimes introduce incredibly irrational constraints on the delivery of the simple, coordinated care plans they need. “Delegation of care” is the strongest and most relevant response legislation offers to voluntary organizations’ demands for independent living, although the term “delegation” is not legally appropriate. These measures were introduced, after much difficulty, in the February 11 Act. They also clash with other measures, which leads to diverging interpretations and limits to their application.
