The legal framework for open data in Spain

During the last five years, several laws have been approved in Spain with the aim of setting up a normative framework for improving the technological modernization of public sector. On this basis, access to public information could be managed by using the open data principles (free access and possibility of an automatic re-use according to European regulation). This paper offers an overview of this regulatory framework and identifies the main difficulties and challenges found in its practical application, based on the scope and configuration of the right of access to information held by Public Administrations and the rest of entities that belong to public sector.
