Deux types de mutations de la prison contemporaine sont aujourd’hui mis en avant par les recherches françaises et canadiennes: d’une part, ouverture et complexification des rapports de pouvoir, qui remettraient en question la notion d’institution totale; d’autre part, émergence d’un référentiel mêlant reconnaissance des droits, responsabilisation et examen des besoins sous l’angle de la gestion des risques, qui complexifierait notamment l’analyse foucaldienne de la prison disciplinaire. En Belgique, la première mutation se heurte à la dégradation des conditions de détention; par contre, l’apparition de nouveaux problèmes et l’évolution des processus de désaffiliation semblent changer les rapports que le détenu entretient avec la prison. Quant à la seconde mutation, ses signes restent très marginaux et persiste le contraste entre institution totale et discours sur les droits des détenus.

French and Canadian researches bring to the fore two sorts of fundamental change in the contemporary prison world. On one hand, there is an opening up and a complexification of the way power operates which would question the notion of prison as a total institution. On the other hand, a model emerges which mixes the recognition of rights, a growing sense of responsability and appreciation of needs in the light of risk management, which in particular would lead to a re-examination of the foucaldian analysis of prison as a disciplinary institution. In Belgium, the first change comes up against a degradation in the conditions of detention, but the emergence of new problems and the evolution of the process of disaffiliation seem to alter the relationships which the detainees have with prison. As to the second change, its manifestation remains extremely marginal and the contrasts persist between the total institution and discourses on the rights of detainees.
