The blind spots of French anti-discrimination law: The circulation of concepts

Under French law, discrimination goes against the principle of equality. However, in order for the anti-discrimination normative framework to be effective, we need to grasp discrimination in all its fullness and complexity. French law alone cannot identify and combat all forms of discrimination without resolutely drawing inspiration from concepts which can be found in other disciplines or legal systems. In this article, the author demonstrates that the circulation of concepts plays a positive role in the fight against discrimination. To this end, he provides first an analysis of the various means through which concepts circulate within the legal system, and then he highlights both the real and potential effects of this circulation on anti-discrimination law.
