L’expertise médicale judiciaire reste une épreuve psychologique pour la victime ; l’application des règles expertales ayant très souvent un effet déstabilisant par rapport à ses certitudes concernant la réparation du dommage. L’expert judiciaire doit, dès lors, expliquer clairement à la victime, dans le cadre du débat contradictoire, le raisonnement médico-légal qu’il retient, permettant d’aboutir à l’établissement du bilan séquellaire en relation causale avec l’accident.

The judicial medical expertise remains a psychological ordeal for the victim; the application of expertise rules having often a destabilizing effect in relation to his convictions regarding the repair of the damage. The judicial expert must therefore explain clearly to the victim, in the framework of the contradictory debate, what forensic reasoning contains, in order to lead to the establishment of a sequelae result in causal relationship with the accident.
