| Summary, etc. | Le Conseil constitutionnel a été saisi le 13 janvier 2023 d’une question prioritaire de constitutionnalité portant sur l’interprétation du sixième alinéa de l’article 114 du code de procédure pénale. La question posée avait pour intention d’apprécier l’équilibre à respecter entre, d’une part, les droits de la défense, principe protégé par l’article 16 de la Déclaration des droits de l’homme et du citoyen de 1789, et, d’autre part, les objectifs de valeur constitutionnelle de protection de l’ordre public et de recherche des auteurs d’infractions. Le Conseil constitutionnel a déclaré que le sixième alinéa de l’article 114 du Code de procédure pénale est conforme à la Constitution. Le juge constitutionnel a procédé, dans son raisonnement, à une démarche en deux temps : justifier l’importance de la protection du principe du secret de l’instruction (I), et souligner qu’au travers de la procédure d’enquête et d’instruction, les droits de la défense sont préservés (II). |

| Summary, etc. | On January 13, 2023, the Constitutional Council was asked to rule on a question of constitutionality relating to the interpretation of the sixth paragraph of article 114 of the Code of Criminal Procedure. The purpose of the question was to assess the balance to be struck between, on the one hand, the rights of the defence, a principle protected by article 16 of the Declaration of the Rights of Man and of the Citizen of 1789, and, on the other hand, the constitutional objectives of protecting public order and tracking down offenders. The Constitutional Council declared that the sixth paragraph of Article 114 of the Code of Criminal Procedure complied with the Constitution. In its reasoning, the Constitutional Court took a two-stage approach : justifying the importance of protecting the principle of investigative secrecy (I), and emphasising that the investigation and prosecution procedure safeguards the rights of the defence (II). |
