| Summary, etc. | Which constitutional order are we talking about exactly? After the political democratic upheavals of the 1990s, marked by resistance, successes, and failures, sub-Saharan Africa has resolutely sought to establish a constitutional order capable of advancing a democratic rule of law. It drew inspiration from constitutional and extra-constitutional values, particularly the objectives and principles set out in the Constitutive Act of the African Union, such as good governance, popular participation, the rule of law, and human rights. The aim of this contribution is to deconstruct and reconstruct a new analytical framework based on current political and institutional crises, seen as obstacles to the establishment of a truly humane democratic order in Africa. This analysis, grounded in the exegesis and sociology of norms, advocates for transitioning the African constitutional order from a dormant or weakened state to a revitalized and dynamic one. |

| Summary, etc. | De quel ordre constitutionnel parle-t-on ? Après les tumultes de la démocratie politique caractérisée dans les années 1990 par les résistances, les succès et les insuccès, l’Afrique noire s’est résolument mise à la recherche d’un ordre constitutionnel qui serait propulseur d’un État de droit démocratique. Elle s’est inspirée des valeurs constitutionnelles et a-constitutionnelles, plus précisément des objectifs et principes énoncés dans l’Acte constitutif de l’Union africaine tels que la bonne gouvernance, la participation populaire, l’État de droit et les droits de l’homme. La présente contribution se propose de déconstruire et de reconstruire une nouvelle grille d’analyse à partir des crises politiques et institutionnelles actuelles, considérées comme des obstacles à l’enracinement d’un ordre démocratique à visage humain en Afrique. Cette réflexion qui se veut une analyse reposant sur l’exégèse et sur la sociologie des normes, suggère de sortir l’ordre constitutionnel africain de son état alité ou émasculé pour un ordre constitutionnel vivifié ou revitalisé. |
