| Summary, etc. | Dans la seconde moitié du xviiie siècle, le juriste normand David Hoüard offre une nouvelle approche à l’étude du droit médiéval qui emporte un double enjeu : d’abord, celui d’une rupture historiographique qui sape le rapport entre l’anarchie prétendue des xe et xie siècles et l’émergence des coutumes provinciales ; ensuite, celui qui, dans le sillage de Jacob-Nicolas Moreau, renoue avec les principes alti-médiévaux du droit constitutionnel de l’Ancien Régime. Ancré dans un primitivisme dont on connaît l’importance dans la littérature juridique du siècle des Lumières, Hoüard entend éclairer les origines du droit normand, mais aussi remonter aux sources du droit français. |

Legal Continuity and Historiographical DiscontinuityIn the second half of the eighteenth century, the Norman jurist David Hoüard created a new approach to the study of medieval law with two main issues: first, a change in the histoiographical paradigm that deflated the relation between the supposed anarchy of the tenth and eleventh centuries and the emergence of provincial customary law; second, following the lead of Jacob-Nicolas Moreau, he insists on the high Middle-Ages’ origin of Ancien Regime constitutional law. Soundly based in the «primitivism » widely present in Enlightenment legal literature, Hoüard hopes to she d light not only on Norman law but also the origins of French law. |
