Summary, etc. | Le long procès autour de la succession d’un riche « bourgeois de Paris » d’origine bourguignonne, l’homme d’affaires Jean-Guillaume Moreau, au cours des années 1730, d’abord devant le parlement de Paris puis devant le Conseil privé, révéla la permanence et l’ampleur d’un servage résiduel original dans certaines provinces du royaume : la condition mainmortable, dont l’épicentre était situé dans les deux Bourgognes (Duché et Comté). L’affaire Moreau, qui occupa toute une décennie, eut un retentissement important, d’autant qu’elle vit l’intervention active de la municipalité parisienne et des états provinciaux bourguignons. Elle s’acheva sur une nette victoire du camp seigneurial, consacrée par un arrêt d’août 1738, qui, repris aussitôt dans la plupart des ouvrages juridiques, consolida le conservatisme de la première moitié du siècle en la matière. Un conservatisme qui devait, cependant, assez rapidement se dissiper à partir des années 1760. |

Summary, etc. | The long lawsuit about the estate of a wealthy Parisian « bourgeois » of Burgundian origin, businessman Jean Guillaume Moreau, during the 1730s, firstly before the parliament of Paris then before the Privy Council, revealed the permanence and magnitude of an original residual serfdom in some provinces of the kingdom : the « condition mainmortable », whose epicentre was by far the two Burgundy (Duché and Franche-Comté). The Moreau case, which lasted a decade, had a significant impact, especially as it saw the active intervention of the Paris municipality and the Burgundian provincial States. It ended with a clear victory for the seigneurial camp, consecrated by a judgment in the month of August 1738, which was immediately taken up in most legal works and consolidated the conservatism of the first half-century in this matter. A conservatism which, however, had to dissipate rather quickly from the 1760s onwards. |
