Summary, etc. | Dans le Midi de la France, les pratiques notariales sont apparues au xii e siècle selon des modalités diverses dans chaque ville. L’objet de l’article est d’analyser la naissance du notariat à Béziers, une cité sans consulat, où le pouvoir est détenu conjointement par l’évêque et le vicomte. Ce sont de fait ces deux autorités qui sont à l’origine de la création des premiers notaires, dans un contexte de tensions après l’assassinat du vicomte Raimond Trencavel en 1167. Un beau dossier documente les procédures de nomination des premiers notaires publics grâce à une charte d’institution en 1174, puis un acte de destitution en 1180, avant une nouvelle nomination. On peut y lire les modalités d’attribution de la charge notariale avec un serment et une redevance annuelle. Ces premiers notaires ont laissé plus d’une centaine d’actes de leur pratique qui permettent d’éclairer les procédures du notariat public aux origines, avec une multiplicité des formes de validation (seing manuel, chirographe, sceau) et une uniformisation progressive des formulaires. Le riche corpus d’actes fournit aussi des renseignements précis sur les études en activité à Béziers jusqu’à la fin du xii e siècle et sur la fin progressive d’un monopole en faveur d’un seul praticien. La nature de la formation de ces professionnels de l’écrit (les notaires et leurs scribes) reste malheureusement dans l’ombre, ainsi que leur milieu social et la rémunération qu’ils pouvaient tirer de leur activité. |

Summary, etc. | The First Notaries of Béziers (end of the 12th century) In Southern France, notarial activity appears in the 12th century with different arrangements in each city. This article analyzes the birth of notarial activity in Béziers, a city without a consulate where power was held jointly by the bishop and the viscount. In fact, it was these two powers that were responsible for the creation of the first notaries in a context of tension after the murder of the viscount Raimond Trencavel in 1167. Well documented records allow us to follow the nomination of the first public notaries thanks to a charter of foundation in 1174, then an act of destitution in 1180 leading to a new nomination. In these charters, we can see how the notarial office was allotted with an oath and an annual payment. These first notaries have left more than a hundred acts allowing us to shed light on their methods at the very beginning with a multitude of forms for validating their acts (manual signature, chirograph, seal) as well as a progressive standardization of forms. This rich body of acts furnishes precise details on the notarial offices active in Béziers up through the end of the 12th century and on the progressive end of a monopoly favoring a sole practitioner. The manner of educating these writing professionals (notaries and their scribes) remains unfortunately in the dark along with their social origins and the fees that they could earn from their activity. |
