| Summary, etc. | L’article a pour but d’examiner si l’attention aux souffrances des êtres humains peut être un guide fiable pour l’élaboration d’une éthique universelle. Cette question générale est considérée en prenant l’exemple des souffrances dues à l’anonymat du don de gamètes dans les techniques d’assistance médicale à la procréation par tiers donneur, au moment où, après plus de vingt-cinq ans de pratique, l’Assemblée nationale française s’apprête à changer ce principe. L’article décrit d’abord le processus d’élaboration et de révision de ce principe dans les débats éthiques et juridiques français, puis il étudie la possibilité de définir un droit fondamental à connaître le tiers donneur. Enfin, il analyse quelques conditions pour prendre cette souffrance comme voie de recherche d’une éthique universelle. |

The case of anonymity in gamete donationThe purpose of the article is to examine if attention to the suffering of human beings can be a reliable guide for the development of a universal ethics. This general question is considered by taking the example of the suffering caused by the anonymity in gamete donation in medically assisted procreation techniques by third party donors, at a time when, after more than twenty-five years of practice, the French National Assembly is preparing to change this principle. The article first describes the process of elaboration and revision of this principle in the French ethical and legal debates, and then considers the possibility of defining a fundamental right to know the third party donor. Finally, it analyzes some conditions for taking this suffering as a way of searching for a universal ethics. |
