| Summary, etc. | RésuméLa construction de l’intercommunalité en France est aujourd’hui encadrée par la loi du 12 juillet 1999 (loi Chevènement). Dans le domaine culturel, les municipalités peuvent être amenées à transférer la gestion de certains équipements (musées, théâtres, bibliothèques ou écoles de musique) à une structure intercommunale. Cette décision implique des discussions et des négociations entre les communes et les agglomérations. À travers l’étude empirique de quatre cas (Amiens, Le Puy-en-Velay, Montpellier et Tarbes), il est possible de caractériser les processus de négociation en jeu et de comprendre le rôle d’encadrement et d’animation qu’y joue l’État. Les travaux théoriques de William Zartman ont été utilisés pour analyser les données empiriques. La notion de « formule de négociation » s’applique à la définition de « l’intérêt communautaire » qui permet d’établir une ligne de partage entre les sphères d’intervention communales et intercommunales. |

| Summary, etc. | The Chevenement law of 12 July 1999 promotes in France the building of intermunicipal policies. For the cultural field, it can encourage municipalities to transfer the management of cultural facilities (museums, theatres, libraries and music schools) to the intermunicipal authority. The decision implies discussions and negotiations between towns and villages. With several cases, involving different urban areas (Amiens, Le Puy-en-Velay, Montpellier and Tarbes), it is possible to characterize the negotiation process and to see how the State regulations and monitoring influence its course. William Zartman’s works proved very useful to analyse the empirical situations. The notion of “negotiation formula” can apply to the definition of “community interest” which enable to draw a borderline between municipal and intermunicipal intervention realms. |
