Summary, etc. | The treatment of adolescent girls by the juvenile justice system is often deemed paternalistic. This assertion relies on official data that reveal that adolescent girls are, above all, brought to justice « for their own good» and not because the citizen’s security requires it. Such an interpretation, however, neglects the possibility that the nature of girls’ deviant behavior would explain, at least in part, the treatment they receive. The analyse of the self-reported deviant activities of a sample of adolescent males and females brought to justice indicates that the nature of the adolescent girls’ treatment is modulated by two elements: the juvenile justice system agents’ paternalistic attitudes and the behavioral profile of the adolescent girls. |

Diese Annahme basiert auf offiziellen Äußerungen, nach denen Verurteilungen regelmäßig mit einem «Wohl für den Jugendlichen» und nicht mit einem Bedürfnis nach öffentlicher Sicherheit begründet werden. Eine derartige Interpretation vernachlässigt allerdings die Hypothese, dass die Art des delinquenten Verhaltens von Jugendlichen zumindest teilweise die erhaltene Behandlung bestimmt. Die Untersuchung selbstberichteter Abweichung von Jugendlichen aus einer Kammer des Jugendgerichts in Montreal zeigt, dass die Art der Behandlung, die die Jugendlichen erfahren, durch zwei Elemente gemildert wird: einerseits durch paternalistische Einstellungen der Akteure in der Justiz und andererseits durch das Verhaltensprofil der Jugendlichen. |
