| Summary, etc. | L’article s’inscrit dans la lignée des travaux menés en sociologie juridique sur la conscience du droit. Il a pour objectif d’évaluer l’effectivité des lois visant à lutter contre les discriminations raciales à partir du point de vue du sujet et dans une perspective de genre. L’hypothèse principale est que les rapports sociaux de sexe, de classe et ethnique ont un impact tant sur la perception de la discrimination raciale que sur le traitement institutionnel des plaintes. Des méthodes quantitatives (analyse de dossiers de plainte) et qualitatives (entretiens avec des juristes et des plaignants) sont utilisées pour parvenir à analyser les différences par genre à trois niveaux : celui de l’expérience genrée de la discrimination raciale, celui de l’utilisation des ressources, celui du traitement genré des plaintes par les institutions. |

| Summary, etc. | The Use Made of Laws against Racial Discrimination in France - a New Perspective on Gender. This article is rooted in research carried out in the field of legal sociology and social awareness of the law and it aims at evaluating the effectiveness of laws against racial discrimination from the point of view of the subject and in the light of an individual’s gender. The hypothesis explored is that social relationships based on sex, class and ethnic origin have an impact both on our perception of racial discrimination and on how complaints registered are dealt with by our institutions. Quantitative (analysis of complaints filed) and qualitative methods (interviews with legal experts and plaintiffs) were used to analyse the role played by gender in each, and this from three different perspectives : experiences of racial discrimination according to gender, use of resources and the handling of complaints filed by institutions according to gender. |
