Summary, etc. | Lors d’une intervention de réduction amélaire interproximale1, l’instrument rotatif utilisé par l’orthodontiste touche le menton de la patiente, lui occasionnant une blessure. La patiente met en cause la responsabilité professionnelle du praticien en invoquant dans son chef l’existence d’une obligation de résultat. La cour d’appel de Liège estime que l’utilisation de l’appareil n’impliquait pas d’aléa dans les circonstances de la cause : le disque rotatif ne devait pas tourner lorsqu’il se trouvait hors de la bouche de la patiente et il suffisait pour ce faire à l’orthodontiste de ne pas appuyer sur la pédale pour l’actionner ; l’aléa était donc bien maîtrisé. Elle retient à charge de l’orthodontiste une obligation de sécurité consistant à ne pas blesser la patiente lorsque l’instrument utilisé – dont il doit garder la parfaite maîtrise – se trouve en dehors de la bouche, qui s’analyse en une obligation de résultat accessoire à l’obligation de soins qui reste de moyens. La cour rejette faute de preuve la cause étrangère exonératoire invoquée par l’orthodontiste. |

Summary, etc. | During an interproximal enamel reduction surgery, the rotating instrument used by the orthodontist touched the patient’s chin, causing injury. The patient challenged the orthodontist’s professional liability, arguing that he had an obligation of result. The court of appeal of Liège considered that the use of the appliance did not involve any hazard in the circumstances of the case: the rotating disc did not have to rotate when it was outside the patient’s mouth, and all the orthodontist had to do was not press the pedal to activate it; the hazard was therefore well under control. It held that the orthodontist had a safety obligation not to injure the patient when the instrument used - which he had to control perfectly - was outside the mouth, which amounted to an obligation of result ancillary to the obligation of care, which remained an obligation of means. For lack of evidence, the court rejected the exonerating foreign cause invoked by the orthodontist. |
