| Summary, etc. | Face au développement de la délinquance des élites, les associations de lutte contre la corruption jouent un rôle essentiel. L’hostilité de la jurisprudence à leur reconnaître le droit d’exercer une action civile devant le juge pénal a conduit le législateur à habiliter ces associations à exercer les droits reconnus à la partie civile. Cependant, cette habilitation est conditionnée, notamment par un agrément ministériel. L’actualité récente montre que l’habilitation législative est un moyen pour les pouvoirs publics de contrôler et éventuellement d’entraver l’action des associations de lutte contre la corruption. |

The reluctance of case law to recognise their right to bring a civil action before the criminal courts has led the legislature to empower these associations to exercise the rights accorded to civil parties.
