Summary, etc. | Cette contribution traite de l’accès aux droits politiques dans le contexte des établissements médico-sociaux (EMS) pour personnes âgées en Suisse romande. Sur la base d’une enquête approfondie au sein de ces établissements, nous montrons comment le milieu institutionnel lui-même peut faire obstacle au vote des résidents, plus que le vieillissement en tant que tel ou les dynamiques de désengagement social qui l’accompagnent souvent. Notre analyse s’appuie sur le courant issu de l’analyse de la street level bureaucracy, qui montre l’importance, pour l’effectivité du droit, des marges discrétionnaires que les agents de terrain mobilisent. Elle s’inspire aussi des Legal Consciousness Studies, qui cherchent à saisir le rapport que les citoyens ordinaires entretiennent avec le droit. Notre enquête montre que les directions d’établissement et leurs personnels sont en position d’interpréter un cadre légal à la fois strict et complexe en matière de droit de vote. Elle identifie les pratiques qui restreignent l’accès aux droits politiques des résidents. Par ailleurs, elle montre que ces pratiques excluantes ne se justifient pas dans un rapport explicite au droit mais bien dans l’ ignorance des législations qui encadrent les droits politiques. Sur cette base, nous recommandons une meilleure information des directions et du personnel de ces établissements concernant les droits politiques et davantage de dialogue social afin que s’élabore collectivement une véritable « conscience du droit » susceptible de garantir la citoyenneté des personnes âgées (et d’autres groupes de personnes institutionnalisées). |

Summary, etc. | This paper thematises institutionalised elderly people’s access to political rights in nursing homes in French-speaking Switzerland. Drawing on a series of in-depth interviews, we argue that the institutional environment itself is an obstacle to voting, more than the residents’ age as such, or institutionalised older people’s general tendency towards social disengagement. Our analysis is inspired by Lipsky’s “street-level bureaucrats” approach that emphasises the importance of the discretionary power of implementing agents on the ground for the actual effectiveness of the law. It is also informed by Legal Consciousness studies that focus on ordinary citizens’ relationship with the law. Our research shows that the strict and complex legal framework regulating voting rights often requires interpretation on the part of nursing home directors and staff. We identify a number of practices that restrict residents’ access to (and exercise of) voting rights. We also show that these excluding practices are mostly due to nursing home staff ’s lack of information about applicable legal rules (and not to their intentional disregarding of rules). On these grounds, we recommend that nursing home management and staff be provided with more complete and accurate information on political rights. We also recommend a wider social dialogue on voting rights, hopefully leading to a genuine “legal awareness” that could contribute to safeguarding the political rights of elderly people (and other groups of institutionalised people). |
